General Terms and Conditions (GTC)

1. Scope

These General Terms and Conditions (GTC) apply to all business relationships between Education Partners II GmbH, Keißlergasse 3, 1140 Vienna (hereinafter referred to as the ‘Provider’), and its business customers (B2B) via the online shop and all online services in Europe and North America. The version of the GTC valid at the time of contract conclusion is decisive.

These GTC also cover the provision of products for download and integration on customer websites, the delivery of certification-related products such as ‘Pawfriendly Office,’ and the promotion of certified companies in marketing campaigns and their display on maps on our website.

2. Contract Conclusion

The presentation of products and services on the Provider’s website does not constitute a legally binding offer but an invitation to place an order. The customer submits a binding offer by completing an order, which the Provider accepts through an order confirmation or by providing a download link.

For ‘Pawfriendly Office’ certifications, products and services may initially be offered free of charge, such as digital badges or badge packages. The customer agrees that their company name and location may be published in marketing campaigns on platforms such as LinkedIn and Meta and on an interactive map on the Provider’s website.

3. Prices and Payment Terms

3.1 Prices:

All prices are net prices exclusive of applicable VAT unless expressly stated as gross prices. Prices are subject to change and errors. The prices specified at the time of the order apply.

3.2 Payment Methods:

Payment can be made via:

3.3 Default Interest:

In the event of payment default, the Provider is entitled to charge default interest of 9% p.a. The Provider reserves the right to claim further damages caused by the delay.

4. Delivery and Digital Content

4.1 Provision of Digital Products:

For downloadable products, the customer receives a download link after the contract is concluded. The customer is responsible for ensuring the technical prerequisites for the download.

4.2 Free Certification Offer “Pawfriendly Office”:

The Provider offers a free ‘Pawfriendly Office’ certification in the first step, providing companies with a digital badge package. Companies using this certification agree that their company name and location may be published in public marketing campaigns on platforms such as LinkedIn and Meta and displayed on an interactive map on the Provider’s website.

5. Customer Data Mention and Publication

5.1 Mention in Marketing Campaigns:

As part of the ‘Pawfriendly Office’ program, the names and locations (addresses) of certified companies may be published in promotional materials and on platforms like LinkedIn and Meta. The customer agrees to this use upon completing the certification. The customer may request the removal of their data from these campaigns at any time by contacting support@dogtisch.academy.

5.2 Integration on a Map:

Certified ‘Pawfriendly Offices’ will be displayed on an interactive map on the Provider’s website with the company name and location (city and country). If the customer does not wish their company to appear on the map, they may object at any time.

6. Right of Withdrawal and Returns

Right of Withdrawal for Consumers (if applicable):

Since the Provider’s offerings primarily target business customers (B2B), there is generally no right of withdrawal for entrepreneurs. If the Provider grants a right of withdrawal in exceptional cases, the customer will be informed in writing on a case-by-case basis.

7. Warranty and Liability

7.1 Warranty:

The statutory warranty rights apply. In the event of defects, the customer has the right to rectification or replacement delivery.

7.2 Liability:

The Provider is only liable for damages caused by intentional or grossly negligent breaches of contract. For simple negligence, the Provider is only liable for damages arising from the breach of essential contractual obligations, but limited to foreseeable damages. This limitation of liability does not apply to damages resulting from injury to life, body, or health.

8. Data Protection

The Provider processes personal data of the customer to fulfill contractual obligations and comply with legal requirements. Detailed information on data processing, use of analysis tools, and marketing services such as Facebook, Instagram, HubSpot, and ActiveCampaign, as well as the publication of customer data in connection with certifications, can be found in the Privacy Policy.

9. Use of Online Services and Third-Party Platforms

The Provider uses various third-party platforms, such as Facebook, Instagram, HubSpot, ActiveCampaign, LinkedIn, and Zoom, to deliver its services. These platforms are used in compliance with applicable data protection regulations and based on data processing agreements. Customers opting for ‘Pawfriendly Office’ certification agree to the use of their company data for marketing purposes on these platforms.

10. Final Provisions

10.1 Jurisdiction:

The place of jurisdiction for all disputes arising from contractual relationships between the customer and the Provider is Vienna, provided the customer is a merchant, a legal entity under public law, or a special fund under public law.

10.2 Applicable Law:

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If the customer is a consumer with habitual residence in another country, mandatory provisions of that country remain unaffected.

10.3 Severability Clause:

If any provision of these GTC is or becomes invalid, the validity of the remaining provisions shall remain unaffected. The statutory provisions shall replace the invalid provision.
